SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF ALABAMA, GEORGIA, NORTH CAROLINA, SOUTH CAROLINA, TENNESSEE AND VIRGINIA WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
1. There are two ways to enter the Ingles FRESCHETTA PIZZAMORÉ™ Sweepstakes: an in-store method and a mail-in method. 1) To enter In-Store. Purchase any FRESCHETTA PIZZAMORÉ® pizza product with your Ingles Advantage Card during one store visit at any participating Ingles retailers from 5/11/08 to 5/24/08, you will automatically receive one sweepstakes entry which will be put into the drawing. 2) Mail-in Entry Method. Hand print name, age, address, city, state, zip code and phone number on a 3" x 5" paper. Mail to: Ingles FRESCHETTA PIZZAMORÉ™ Sweepstakes, PO Box 3114, Grand Rapids, MN 55745-3114. Enter as often as you wish, but each entry must be hand written, mailed in a separate stamped envelope, be postmarked by 5/24/08 & received by 5/30/08. Sweepstakes begins 5/11/08 ends 5/24/08. No mechanically reproduced, illegible, or incomplete entries. Sponsor assumes no responsibility for incorrect or inaccurate entry information or for incomplete, lost, stolen, late, misdirected, misplaced, mutilated, or postage due entries or mail. Sponsors are not responsible for misdirected, inaccurate, incomplete, lost, late, delayed, undelivered, postage-due, damaged or illegible entries, and all such entries will be void. Sponsors are also not responsible for errors or problems which may occur in connection with or relating to the Sweepstakes, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing or judging of entries, the announcement of prizes in any Sweepstakes-related materials or that may limit prize fulfillment or a participant's ability to enter the Sweepstakes. Sponsors reserve the right, in their sole discretion, to cancel, modify or prematurely conclude the Sweepstakes should any fraud, tampering, unauthorized intervention or other cause beyond their control corrupt the administration, security or proper operation of the Sweepstakes. If the Sweepstakes is cancelled, Sponsors may, in their sole discretion, select winners from the entries received up to time of such action.
2. Prizes/Drawing: [1] Grand Prize: Grand Prize Winner will receive a $5,000.00 Best Buy® gift card to be used toward the purchase of a home theater makeover. Approximate Retail Value (“ARV"): $5,000.00. [10] First Prizes: First Prize Winners will each receive a $50 Ingles gift card. ARV: $50.00/each. Total Retail Value of all prizes: $5,500.00. Odds depend upon the number of eligible entries received. Winners will be selected from among all eligible entries received in a random drawing to be conducted on or about 5/25/08 by Arrowhead Promotion & Fulfillment Co., Inc., whose decisions are final. Winners will be notified by mail or phone within two (2) days of the May 25, 2008 drawing. All prizes will be awarded as long as there are a sufficient number of eligible entries received. Prize is awarded “as is" with no warranty, representation, or guarantee, express or implied, in fact or in law, made by Sponsors or for which Sponsors shall be liable, including, without limitation, any implied warranties of merchantability, non-infringement or fitness for a particular purpose. LIMIT: One prize per household. Sponsors reserve the right to substitute a prize of comparable or greater value in the event a described prize, or any portion thereof, is unavailable for any reason whatsoever Winners and/or their parents or legal guardians are responsible for the reporting and payment of all federal, state and local taxes incurred by acceptance and use of the prize (or any portion thereof).
3. Winner Notification: Potential Winners will be notified by Sponsors within approximately two (2) days of determination by the contact information provided on his/her entry. Winners must also meet all eligibility requirements, including the execution and return of all necessary releases. In the event any potential Winner is a minor, the prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on Winners set forth herein. Potential Winners (and/or their parents or legal guardians if such entrants are minors) may each be required to provide proof of identity, address and birth date, as well as execute and return an affidavit of eligibility, tax acknowledgment form, liability release and, except where prohibited by law, publicity release within fourteen (14) days of date of issuance either via facsimile or US registered mail in order to claim the prize. If any potential Winner fails to do so or if: (i) any prize notification is returned as undeliverable, (ii) a potential Winner declines to accept the prize, or (iii) a potential Winner is determined to be ineligible for any reason, such potential Winner will be disqualified and, at Sponsors' sole discretion, an alternate winner will be selected. All prizes will be awarded.
4. Eligibility: Open to legal residents of the state of Alabama, Georgia, North Carolina, South Carolina, Tennessee and Virginia who are 18 years of age or older at time of entry, except employees or agents of Sponsor, Ingles, their subsidiaries, divisions, affiliates, agencies, & members of their immediate families. If prize is won by a minor, it will be awarded in minor's name to a parent or legal guardian, who must sign all required documents. Void in the other 44 states, PR and wherever taxed, prohibited or restricted. Subject to all federal, state & local laws & regulations.

6. Disputes: Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resorting to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Minnesota; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law, rules or provisions (whether of the State of Minnesota or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Minnesota.
7. General Rules/Regulations: By entering this Sweepstakes, entrants (and/or their parent or legal guardian): (i) agree to be bound by the decisions of Sponsors and judges which are final and binding in all matters; and (ii) grant Sponsors and their designees the right, unless prohibited by law, to use their names, cities and states of residence, voices, pictures and likenesses, without compensation, notification or permission, for the purpose of advertising and publicity in any and all media, now or after known, throughout the world in perpetuity. Sponsors, expressly disclaim any responsibility and entrants (or their parents or legal guardians if such entrant is a minor) agree to release, indemnify and hold Sponsors harmless for liability, damages or claims for injury or loss to any person or property (including death) relating to, in whole or in part, directly or indirectly, participation in this Sweepstakes, the acceptance and/or subsequent use or misuse of any of the prizes awarded claims based on publicity rights, defamation or invasion of privacy. Sponsors further assume no liability either for the cancellation, modification or premature conclusion of the Sweepstakes for any reason or through the acts or defaults of any company or person providing any prize. All such losses or expenses must be borne by the affected participants, entrants and/or Winners.
